Renewable & Alternative Energy

FPS&S has long maintained a strong presence in the fields of municipal water issues. That foundation led our attorneys to naturally transition to work involving renewable and alternative energy projects coinciding with the proliferation of projects in that field. As a result, FPS&S has become a regional leader in representing counties and municipalities in connection with development, negotiation, and operation of a variety of energy facilities including battery energy storage systems (BESS), wind, and solar.  Our attorneys are sought after for their skill in negotiating on behalf of counties for the development of some of the largest wind and solar development projects in the region as well as placing reasonable prohibitions on such facilities when necessary.  Our capabilities include:

  • Representing municipalities in energy contracting and transactions to facilitate efficient use of energy services and municipal resources.
  • Assisting zoned and un-zoned municipalities with a broad range of energy related legal issues.
  • Comprehensive advice, strategy, and solutions for counties and municipalities approached by energy developers seeking potential wind or solar development within their jurisdictions.
  • Due diligence management and review of behalf of counties engaged in energy development.
  • Land use issues and permitting.
